In accordance with regulations of Anti-dumping Regulations of the People¡¯s Republic of China, Ministry of Commerce released Announcement No.56, 2006 on Aug 15, 2006, deciding to carry out investigation on anti-dumping measures applicable to imported dichloromethane originated from Britain, the US, Netherlands, Germany and South Korea.
The commodity scope in the review shall be consistent with commodity scope regulated in Announcement No.20, 2002 of the former Ministry of Foreign Trade and Economic Cooperation.
In line with article 48 and 50 of Anti-dumping Regulations of the People¡¯s Republic of China, Ministry of Commerce investigated the possibility of dumping and injury, or the return of dumping and injury, and suggest the Tariff Committee of the State Council Continue the anti-dumping duties in accordance with investigation.
In line with investigation and decision of the Tariff Committee of the State Council, related issues are now announced as follows:
1. Arbitration
the investigation shows that if the anti-dumping measures are terminated, the dumping of the imported dichloromethane originated from Britain, Korea and the US probably arise again; dumping of the imported dichloromethane originated from Germany and Netherlands probably arise again; the imported dichloromethane originated from Britain, the US, Netherlands, Germany and South Korea probably injure Chinese domestic industry again.
2. Anti-dumping Measures
In accordance with Article 50 of Anti-dumping Regulations of the People¡¯s Republic of China, the Tariff Committee of the State Council decides to continue to follow the commodity scope and anti-dumping duty rate of Announcement No.20, 2002 of the former Ministry of Foreign Trade and Economic Cooperation to impose anti-dumping duties on imported dichloromethane originated from Britain, the US, Netherlands, Germany and South Korea as from release of this announcement, the duration of which is five years.
3. This announcement shall take effect as from Aug 25, 2007.
4. Administrative Review and Administrative Litigation
In accordance with Article 53 of Anti-dumping Regulations of the People¡¯s Republic of China, if interested parts refuse to accept decision of the review, he or she may initiate an administrative review or bring an administrative suit to the people¡¯s court.
